The Delhi high court on Thursday barred the Delhi Development Authority (DDA) from taking coercive steps against the Shahi Idgah Management Committee over a ₹12 lakh recovery notice issued for using Eidgah Park during the annual Ijtema congregation held in December 2024.
NEW DELHI:
The notice, dated February 11, claimed the parkland belonged to DDA and sought booking charges for the religious event. However, Justice Vikas Mahajan granted interim protection, observing that the committee had no available legal remedy as the Delhi Waqf Tribunal is currently non-functional.
"The problem is that the tribunal is not functional. Till that time, he (the committee) has no remedy. It is a government land, but he is not encroaching upon it. It is a religious function — the recovery can come later on," the judge remarked during the hearing.
