HC Awards ₹3.34 Cr to J&J in Trademark Infringement Case

The Delhi high court has awarded ₹3.34 crore as damages to healthcare giant Johnson and Johnson (J&J) in a trademark infringement suit filed by the former against two people for selling counterfeit surgical devices and medical products under its mark SURGICEL, ETHICON; asserting that their conduct posed a severe risk to public health and safety.

In his verdict delivered on Tuesday, a bench of justice Amit Bansal underscored the impact of selling counterfeit products on the lives of the people. Awarding ₹2.34 crore as compensatory damages and ₹1 crore as exemplary damages, justice Bansal maintained, "The counterfeit medical products sold by the defendants pose a significant threat to public health. Counterfeiting of medical devices is not merely a case of trademark infringement, it is a grave offence that endangers the lives of people."
