Calcutta HC Allows BJP To Hold Rath Yatras In Bengal

Threat to law and order must be real, says judge

The Calcutta High Court on Thursday set aside the Trinamool Congress government's order of December 15, denying permission for the 'rath yatras' proposed by the BJP in West Bengal.

The court observed that the threat to public order "must be real, not imaginary or a likely possibility" for denying permission to a political rally.

Justice Tapabrata Chakraborty allowed the BJP to organise three rallies under the following conditions: it will inform the Superintendent of Police 12 hours before the entry of the yatra in the district; abide by traffic regulations and keep ecological impact in mind; and follow every just direction given by the administration.
