Shortly after we attained independence, we proclaimed ourselves ‘Sovereign’ in the Preamble of our Constitution. Seven eventful decades passed by, wading through the highs and lows of Democracy. We are still struggling to release our boots from the colonial shackles that penetrated deep into the Indian soil for over a period of three centuries. The introduction of Common law and the establishment of the British legal system in India, only to the convenience of the British Monarchy are practiced even today! The Indian legal system functions in the enriching shadows of the long lasting impressions set by the British Raj in the form of Procedural Codes, penal laws and family laws. The linguistic convenience of the English led to renaming our major cities and the High Courts of Bombay, Madras and Calcutta that continued the legacy up till now when it was decided to rename them back to pre-Independence names. Better late than never! But the most intriguing question is, does it really take so long to realise our roots? And why does the law resist changes? Is it because the law as we know too was formulated by the British or can we attribute any other reason? Why are we so hesitant to reclaim ourselves as truly independent Indians? Many such questions are raised and answered, along with the significant judgments of the Supreme Court in independent India in our cover story on the occasion of 70th Independence Day written by Manisha Karia, Advocate on Record of the Supreme Court of India.
