Megachurch preacher enters peace bond after Crown finds no reasonable prospect of conviction’
The remaining sexual assault charges against former megachurch pastor Bruxy Cavey have been withdrawn.
The two charges were withdrawn in a Hamilton courtroom on Wednesday after Cavey agreed to a peace bond, assistant Crown attorney Mark Dean confirmed to The Hamilton Spectator.
The criminal liability in the case hinged on the “meaning of consent,” Dean said, and whether consent in the case “was induced by the accused’s abuse of his position of trust, power or authority toward the complainant.”
After “careful consideration” of elements of the case, including the allegations and anticipated evidence from the complainant and an independent witness, the Crown determined there was “no reasonable prospect of conviction,” Dean said.
The latest news surrounding Cavey comes less than two months after a separate sexual assault charge was stayed in July over court delays after Cavey’s lawyer successfully argued that his right to a timely trial was breached.
