COMPLEX MATTER
THE NATIONAL Prosecuting Authority's Director of Public Prosecutions in the Eastern Cape, Barry Madolo has decided to appeal the Gqeberha High Court's ruling which acquitted Nigerian televangelist Timothy Omotoso and two others of various crimes.
The judgment was delivered by Judge Irma Schoeman last month. The judge had found Omotoso and his co-accused, Lusanda Sulani and Zukiswa Sitho not guilty on charges of rape, human trafficking, and racketeering. The court found that the previous prosecutors had acted improperly and had failed to cross-examine the accused adequately.
NPA spokesperson, advocate Mthunzi Mhaga said this decision follows a thorough consideration of the matter by an NPA internal team of experienced prosecutors, as well as a legal opinion sourced from senior counsel.
"The decision could not be rushed due to the complexity of the matter and the voluminous transcript that needed to be interrogated.
