Delhi High Court grants relief to BharatPe, restrains use of 'Bharatpay' mark and website

The court stated that, 'It being a prima facie case of infringement of trade marks and passing off is made out on behalf of the plaintiff in its favour.'

The Delhi High Court in the case Resilient Innovations Private Limited Versus M/S Bharat Pay And Ors observed and has granted relief to fintech company "BharatPe" and the court restrained the use of "Bharatpay" mark as well as the domain name which is being used for payment of utility bills, data recharge services, insurance and financial services.

The bench headed by Justice Amit Bansal was hearing the present matter.
