Allahabad High Court: Allegations Of Adultery Against Wife To Be Decided Before Application For Maintenance Under Section 125 CrPC

The court in the case observed that the Trial Court had no observations with regards to the allegations of adultery on part of the wife. The court in the case granted interim stay on the order of the Trial Court. The court while considering the facts and circumstances of the case observed and has directed the parties to exchange affidavits.

The Allahabad High Court in the case Dr. Virender Kumar v. State of U.P. and Another observed and has held that allegations of adultery against wife must be decided before the application for maintenance under Section 125 of Code of Criminal Procedure, CrPC.
