I need support to raise a court action against a Landscaper. I recently paid a Landscaper £4000 to complete some work in my back garden.

The work was carried out over three months, but upon completion, I noticed that the decking was of unsatisfactory quality.
I asked the landscaper to rectify the problem but they refused to do so. I was forced to ask another landscaper to give me a quote to fix the problem. I was quoted £1200 for the new landscaper to remove the broken slats and replace them with new ones. What action should I take, and can you provide a step-by-step guide?

You have done what we would have advised in the first instance: you have contacted the landscaper and asked them to rectify the issues with the decking.
Court action should be the last resort in any dispute, however, we know how frustrating it can be when the other party to a case refuses to make a problem right and has left you with little option but to involve the court.
I have written a handy step-by-step guide to guide you through the process of raising a Simple Procedure claim. A simple procedure claim can be made:
■For payment of a sum of money where the value of the claim is £5000 or less.
■For delivery, or recovery, of possession of moveable property, but only where there is an alternative claim for payment of a sum of money of £5000 or less.
■For an order to make someone do something specific, but only where there is an alternative claim for payment of a sum of money of £5000 or less.
