PC Stays In Tihar As CBI Court Will Not Accept Plea

Observing “investigation is the prerogative of the investigating agency” and “interference from court is to be avoided”, the special CBI court on Friday turned down former Finance Minister P Chidambaram’s request to surrender before the Enforcement Directorate (ED).

The order of Special Judge AK Kuhar comes a day after the ED informed the bench that it is conducting a “background investigation” into the money laundering case against the former Finance Minister in the INX media case, and would take him into custody at an appropriate time.

Judge Kuhar in his order also noted that legally, an accused can only be sent to Judicial custody or police custody after he has either been arrested by the investigation agency or there is a complaint or charge sheet against them.
