Living together of a couple without marriage is not an alien concept in India. It has been prevalent since ages, nevertheless, it has now become an obvious issue because of societal shift from conservative to progressive along with so called liberalisms. Such relations were considered to be immoral and were not acceptable to the conservative Indian society. The issues arising out of such relations were often never raised or spoken about. However, with the advent of technology and easy exposure to Western culture, today, the concept is more or less accepted with remorse. As a result, the failures in such relationships have gained attention and are in open, demanding justice where denied. The issues such as maintenance, domestic violence, rights of children born out of such relations, etc. have come to the fore and have become a huge problem for Courts, which in principle, ‘INTERPRET and Guide and not LEGISLATE’. Ironically, most of these issues have been adequately addressed by the colonizers themselves, in their own jurisdictions now.
