The U.S. Department of Commerce announced the repeal of a Biden-era regulation that would have restricted the export of artificial intelligence chips to over 100 countries, a move set to take effect on May 15, 2025.

For chipmakers, international markets, and policymakers, this shift could reshape the $500 billion semiconductor industry, with implications for the $2 trillion Al market.
The rescinded rule, known as the Framework for Artificial Intelligence Diffusion, sorted nations into three tiers, imposing caps on chip exports to 120 countries and strict bans on adversaries like China and Russia. Critics, including Microsoft's president Brad Smith, argued it risked pushing allies toward Chinese tech, undermining U.S. leadership.
The Trump administration plans to replace it with a new policy focused on direct negotiations with trusted nations, though details remain unclear.
BACKGROUND OF THE RESCINDED RULEThe Biden administration introduced the AI Diffusion Framework in January 2025, aiming to balance national security with economic interests.
The rule divided countries into three tiers: 17 allies like the UK and Japan faced no limits, 120 nations in a middle tier had export caps, and adversaries like China, Russia, Iran, and North Korea were fully restricted. It built on existing bans, such as those on Huawei’s Ascend Al chips, but closed loopholes by broadening oversight, requiring federal approval for exports to many markets, including Middle Eastern countries where Trump was visiting during the announcement.
