Faculty shortage not valid ground to reject VRS applications: Orissa High Court

IN a significant judgment, the Orissa High Court has ruled that the state government cannot deny voluntary retirement (VRS) applications solely on the grounds of faculty shortages.
The Court declared such rejections to be illegal under existing laws.
The ruling came in response to a petition filed by Dr. Rabi Narayan Dhar, a senior professor of orthopaedics with 27 years of service, whose VRS application was turned down by the state government in February 2024.
Dr. Dhar had submitted his application for VRS on December 27, 2023, under Rule 42 of the Odisha Civil Services (Pension) Rules, 1992, citing personal and health-related reasons.
