BSKE postponement constitutional - SC

The Supreme Court (SC) has affirmed the legality of a law postponing the December 2025 barangay and Sangguniang Kabataan elections, which extended the term of incumbent BSK officials and gave them a term of four years instead of three.

The SC declared Republic Act 12232 constitutional, resetting the BSKE from Dec. 1 to November 2026.

The high court denied the consolidated petitions questioning the legality of the law, which set the next BSKE on the first Monday of November 2026 and every four years after.

The petition, filed by election lawyer Romulo Macalintal, argued that the law is void for failing to comply with guidelines in postponing elections.

The law also violates the public’s right to vote and unduly favors BSK officials, Macalintal said.
