THE Supreme Court has granted Congress leader Pawan Khera anticipatory bail in connection with the FIR registered by Assam Police on the complaint by CM Himanta Biswa Sarma’s wife, Riniki Bhuyan Sarma, over his allegation that she held multiple passports and property abroad.
Thursday’s order of the SC was uploaded on its website on Friday.The Gauhati High Court had on April 24 rejected Khera’s plea for anticipatory bail, following which, Khera moved SC.
The two-judge bench of Justices JK Maheshwari and AS Chandurkar said: “Observations made by the HC in the impugned order are not based on correct appreciation of all the material which has been placed on record and appear to be erroneous, in particular shifting the burden on the accused.”
The court also directed Khera to be released on anticipatory bail in the event of his arrest in Crime Branch Police station in Case No. 04/2026 and on such reasonable terms and conditions as deemed fit.
