FIR can be filed 10 yrs after crime in different place: SC

The Supreme Court has dismissed the plea filed by a Deputy Superintendent of Police (DSP) in Bihar, Somesh Kumar Mishra, against whom a First Information Report (FIR) was registered after a 10-year delay at a location where the alleged crime did not occur.

He questioned why the FIR was registered outside of the place where the crime was supposedly committed, particularly since the prosecution claimed the offence took place in Delhi. A two-judge bench of Justices Dipankar Datta and Manmohan refused to quash the FIR filed against Mishra.

Mishra had previously filed a Special Leave Petition (SLP) in the Supreme Court after the Patna High Court denied his request to quash the FIR in 2022. Now, Mishra will have to face the trial in Bhagalpur after the SC rejected his plea. He has been chargesheeted by the investigating agency under 376 (Rape) of the IPC.
