RA 12232 sets a four-year term for barangay and SK officials, with a maximum of three consecutive terms for barangay officials and only one term for SK officials in the same position.

It also moves the BSKE from December 1, 2025 to the first Monday of November 2026, and every four years thereafter.

Under the law, current barangay and SK officials serving their third consecutive term in the same position will not be eligible to run in the November 2026 polls.

In signing the measure, Marcos said the postponement was necessary to allow the Comelec to focus on the first-ever Bangsamoro Autonomous Region in Muslim Mindanao (BARMM) parliamentary elections set for October 13, 2025.

In his petition, however, Macalintal argued that RA 12232 postpones the 2025 BSKE “without any valid, genuine, or compelling reasons, nor any objective and reasonable criteria,” as required by the Supreme Court in Macalintal v. Comelec, which struck down RA 11935—the law postponing the December 2022 BSKE—as unconstitutional.
