CONSENT MUST | No transfer possible without teachers’ consent, says HC

A Division Bench of the Kerala High Court has held that teachers in aided colleges cannot be transferred between universities without their explicit written consent, dealing a sharp legal rebuff to the Travancore Devaswom Board and the Nair Service Society.

The order quashes inter-university transfers that were effected to protect favoured individuals and to conceal irregular appointments made without sanctioned posts or adequate workload.

The judgement stems from writ petitions in which Justice N. Nagaresh earlier invalidated transfers made from Mahatma Gandhi University to Kerala University without the affected teachers’ consent.
