Supreme Court deletes adverse remarks made by Uttarakhand High Court against advocate without opportunity of hearing: 'Nobody can be condemned unheard'

The Supreme Court in the case Dushyant Mainali Versus Diwan Singh Bora And Anr observed and has expunged the adverse remarks against an advocate recorded by the Uttarakhand High Court without providing opportunity of hearing.

The court in the case set aside the direction of High Court to the State Bar Council to initiate misconduct proceedings against the advocate without affording him an opportunity of hearing to respond to the allegations labeled against him.

The court stated that, 'This court is of the considered view that the approach of the High Court in making the observations against the appellant without giving him any opportunity of being heard is totally unsustainable in law.'

The bench comprising of Justice BR Gavai and Justice KV Viswanathan was hearing the present matter.
