Supreme Court Stayed High Court Judgement Which Refused To Quash Case Against Person for Calling Congress President Kharge 'Ayogya'

The Supreme Court in the case Mithun Chakravarty Devidas Shet versus The State Of Karnataka observed and has stayed the operation of the Karnataka High Court judgment, wherein the court allowed the investigation against a person accused of calling the President of All India Congress Committee, AICC Mallikarjun Kharge as 'Ayogya'.

The bench comprising of Justice MM Sundresh and Justice Pankaj Mithal was hearing the present matter. The bench in the case observed and has passed an interim order wherein the court issued notice on the petitioner's special leave petition.

The High Court in its order quashed the charges under the SC/ST (Prevention of Atrocities) Act under section 3(2)(v-a) but dismissed the challenge against offences under Section 153-A, Section 153-B, Section 505(2) of the Indian Penal Code.
