Court restrains respondents from taking over affairs of Gurdwara Chatti Patshahi Tali Sahib

In a suit filed by Balvinder Singh and Surjeet Singh Vice President and Secretary District Gurudwara Prabandhak Committee for declaration to the effect that the, letter bearing No. DGPCJ/077/2025 dt. May 3, 2025 issued by the defendant No.1 authorizing the defendant No.2 to appoint and announce a local committee of Gurdwara Chatti Patshai, Talab Tillo, Jammu be declared as void ab-initio, null and void and also the suit for declaration to the effect declaring the Letter with Ref. No. 22/2025 dt. May 5, 2025 issued by the defendant No. 2 to appoint Harpreet Kour, daughter of Janak Singh, resident of Bhagwati Nagar, Jammu (Defendant no.3) and Manmohan Singh, son of Manohar Singh, C/O Gurdwara Chand Kour, Chand Nagar, Jammu (Defendant no.4) as President and Secretary of Gurdwara Chatti Patshai Talab Tillo, Jammu be declared as null and void with a consequential relief of permanent prohibitory injunction restraining the defenda No. 3 and 4 from acting as President and Secretary. Sub-Judge Jammu Sunil Koul after hearing both the sides restrained the respondents from taking over the affairs of Gurdwara Chatti Patshahi Tali Sahib.

Sub-Judge Jammu Sunil Koul after hearing both the sides observed that from the plain reading of J&K Sikh Gurdwaras & Religious Endowment Act read with relevant rules i. 11, 13, 14 of the Act read with Rule 49 and 50 framed under the act it is clear that no individual power has been vested in any member of the committee i.e. District Gurdwara Parbandhak Committee constituted for any district or one or more district jointly to do any act which the committee m empowered. From the facts and circumstances of the present easels clear that plaintiffs at this stage have been able to raise tribal issue which requires to be determined in trial i.e. issue with respect to power of the members of the C
