In Badlapur custodial death case, Supreme Court modifies Bombay HC order; Maharashtra Police chief to probe matter now

The Supreme Court Monday modified the Bombay High Court order of a probe by a Special Investigation Team (SIT) into the Badlapur custodial death case under the supervision of Lakshmi Gautam, Joint Commissioner of Police (Crime), Maharashtra Police.While hearing the appeal filed by the Maharashtra Government against the High Court order, the apex court directed that the SIT be supervised by Rashmi Shukla, Director General of Police, who can then constitute the SIT to probe the matter.

Hearing the appeal, a bench of Justices Bela M Trivedi and PB Varale stated that being aggrieved by the order based by the Bombay HC to the extent of constituting the SIT under the supervision of Gautam, Solicitor General Tushar Mehta has submitted that the state has no objection with an SIT but asked for it to be constituted under the supervision of DGP, having regards to the litigations made.The bench said, considering the nature and seriousness of the allegations, it modified the order, and directed that SIT be constituted by Shukla, and officers selected by the DGP as deemed fit. The bench said if the complainant had any grievance, they could approach the competent authority while disposing o
