Information Regulator failed in interpreting its own POPI Act

THE recent jurisprudential embarrassments suffered by the Information Regulator (IR) reveal a disturbing incapacity to correctly interpret and enforce the very law it is mandated to uphold - the Protection of Personal Information Act (POPIA).
In Information Regulator v Minister of Basic Education and Others, the High Court struck the IR's urgent application to bar publication of the 2024 matric results from the roll, finding there was no urgency and criticising the Regulator's delay and lack of evidence of actual prejudice to learners' privacy. The application was dismissed, and the Regulator was ordered to pay costs.
