The driver and bodyguard employed by Madibeng Local Municipality's mayor, Douglas Maimane appeared in the Pretoria Magistrate's Court on Monday, 2 February on charges of murder and defeating the ends of justice after fatally shooting Michael Swanton (36), a husband and father of two young children on Wednesday night, 28 January on die R80, known as the Mabopane Main Road near Hercules.

According to Swanton's wife, Stephanie, an unmarked SUV with a single blue light on the windscreen, signalled them to pull over, but no siren sounded. Allegedly the vehicle had no official identification marks and they carried on driving towards Mabopane when their vehicle was boxed in and they had to stop.
Apparently, the driver and passenger of the BMW X3 got out and made their way to the Swanton's vehicle, one armed with a R5, a 5.56mm assault rifle, questioning Swanton about the missing rear number plate on his vehicle.
