24-Hour Rule Begins From Detention, Not Arrest, Rules KLHC

The Kerala High Court on Tuesday ruled that the 24-hour period for producing an accused before a magistrate starts from the moment their liberty is effectively curtailed, not from when the police formally record the arrest.
Justice Bechu Kurian Thomas said the practice of delaying the arrest under various pretexts is sometimes used during investigations, creating scope for police excesses.
"Such unrecorded periods of custody can become a source of human rights violations," the court observed.
