HC warns against misuse of Pocso Act

The Madurai Bench of the Madras High Court has issued directions regarding the misuse of the Protection of Children from Sexual Offences Act, 2012, acknowledging an increasing trend of false complaints being filed under the law for personal or political reasons.
Justice B Pugalendhi, in a ruling made this week, highlighted that trial courts should now ensure that cases are registered against adults who deliberately file false complaints under the Pocso Act.
The court’s observations came during the dismissal of a petition filed by a BJP functionary, Sahirsha alias MS Sha, who sought to quash a case registered against him. He had been accused of sexually harassing a 16-year-old girl by sending obscene messages to her in 2024. The allegations, however, were contested by Sha, who argued that the complaint was fabricated as part of a personal vendetta.
