Supreme Court Critiques Anticipatory Bail Condition That Accused Should Be Arrested After Filing of Chargesheet

The Supreme Court in the case Ritesh Kumar Versus The State Of Bihar observed and has disapproved the anticipatory bail order of Patna High Court, wherein the court imposed a condition that upon filing of the charge sheet, the trial court shall take coercive steps against the applicant, which includes an arrest.

The bench comprising of Justice Ahsanuddin Amanullah and Justice Prashant Kumar was hearing the present matter.
The bench in the case observed and has called for imposition of such a condition to be unwarranted and instead it has been stated that the High Court could have left it open for the trial court to take a call on taking coercive steps after the submission of the chargesheet.
