MEMORANDUM ON ARTICLE 174(1) NON-COMPLIANCE SUBMITTED TO PRESIDENT, PM, AND GOVERNOR

The previous Session of current 14th TH Haryana Legislative Assembly (Vidhan Sabha) was summoned on 13 March 2024 and as per mandate of Art 174(1) of Constitution of India, its next Session should be summoned before 12 September 2024 however till date, the Summoning Order for next Session of Haryana Vidhan Sabha has not been notified by the Governor of Haryana on the recommendation of the State Government of Haryana.

Pertinent as per Judgment of a Constitution Bench of Supreme Court of India in Re: Special Reference Case 1 of 2002 - Under Article 143(1) of the Constitution of India (Decision dated 28 Oct 2002), the provisions of Article 174 of Constitution of India are mandatory in character so far as the time period between two Sessions is concerned in respect of live Assemblies (as is the case with current 14th Haryana Vidhan Sabha whose 5 years tenure is till 3 November, 2024). In continuation to aforesaid, it is noteworthy that a Memorandum cum Representation has been submitted to Droupadi Murmu, President, Republic of India, Narendra Modi,
