Allahabad High Court: 30-Day Deadline For Issuing Show Cause Notice Under OMC's Marketing Discipline Guidelines Is Mandatory

The Allahabad High Court in the case Gyanendra Kumar vs. Union Of India And 7 Others observed and has held that the 30-day deadline for issuing a show cause notice, as outlined in Clause 8.5.6 of the Marketing Discipline Guidelines, 2012, framed by the Oil Marketing Companies, OMCs, is mandatory in nature.

The bench comprising of Justice Shekhar B. Saraf and Justice Vipin Chandra Dixit was hearing the present matter.

The bench in the case observed and has allowed a writ petition filed by Gyanendra Kumar (dealer) challenging a show cause notice issued to him dated September 8, 2023, with regard to an alleged discrepancy found in the joint inspection.

However, the Public Sector Oil Marketing Companies, OMCs have formulated and implemented Marketing Discipline Guidelines, MDG to check irregularities or malpractices at retail outlet, RO dealerships.
