CANADIAN prosecutors’ have won a battle in to extradite three Scots wanted for alleged involvement in the death of a restaurant owner.

- By James Mulholland

The decision came after lawyers successfully argued to a sheriff that the alleged crimes said to have been committed by the three were also applicable in Scots law.

The case centres on the death of Sharif Rahman who was killed in Ontario in 2023.

Prosecutors claimed it was the result of a fight following a dispute over an unpaid $150 restaurant bill at an Indian restaurant in the city of Owen Sound around 150 miles north of Toronto.

They stated that 44-year-old Mr Rahman followed three men into the street outside The Curry House where a fight is alleged to have ensued.

The married father-of-one was found injured by a staff member and died in hospital a week later.

Police in Ontario later announced Robert Evans, 24, had been charged with manslaughter.

His father, Robert Evans, 47 and his uncle, 54-year-old Barry Evans were also charged with accessory after the fact to commit an indictable offence. In order to be extradited from Scotland, prosecutors have to show that there is an equivalent offence in Scottish law.
