David Birrell, defending, said on his behalf: “There was no actual loss here. There was, I suppose, a risk of loss to the customers that they might lose money or be refused money. That was remote. These defendants offered a money back guarantee.”

He said his client, a father of three, does voluntary and outreach work in the community.

Louis James, 37, of Lapford Crescent in Kirkby, pleaded guilty to fraud before the trial.

James’ counsel Damian Nolan said: “This is, in many ways, a victimless crime. Anyone who dealt with them got their tickets.”

He said James is a carer for his mum.

Smith, 38, of Moss Lane in Ormskirk, also admitted fraud.
