Meta contests CCI fine on WhatsApp privacy rules

Social media company Meta argued before the National Company Law Appellate Tribunal (NCLAT) on Thursday that the Competition Commission of India (CCI) had no authority to question WhatsApp’s 2021 privacy policy, claiming none of its 500 million Indian users had objected to the terms.
The company is contesting a ₹213.14 crore penalty imposed by the competition regulator over the messaging platform’s privacy policy changes.
Senior advocate Kapil Sibal, representing Meta, told a bench comprising NCLAT chairperson Justice Ashok Bhushan and technical member Arun Baroka that the CCI lacked jurisdiction over data protection matters, as its mandate under the Competition Act was confined to commercial and market issues.
“Privacy is a matter between the platform and its customers, nota competition concern. And when not one of my 500 million users have a complaint, who is CCI to raise an issue?” Sibal argued.
