RAF told to pay up after flawed investigation

THE Gauteng High Court, Johannesburg, ordered the Road Accident Fund (RAF) to pay general damages to an accident victim, after a previous court ruled that the individual was not liable for compensation.

The plaintiff, Louis Bekker, told the court that he was involved in a car accident on April 15, 2017, while travelling with his family in the North West Province.

He stated that he was intoxicated at time, and as a result, his wife drove the Isuzu bakkie they travelled in, which belonged to his friend, Gerard Fourie (Fellies).

He said they agreed with Fellies that he would take over the hire purchase instalment of the bakkie.

“My wife Maria Bekker was driving at a low speed when the oncoming motor vehicle appeared, travelling with bright lights on and at an high speed. I noticed my wife switching on bright lights, but the car kept moving to our side.”
