R320m Durban Solid Waste case fraught with delays

A TRIAL-within-atrial to determine the admissibility of evidence obtained from former eThekwini city manager Sipho Nzuza’s cellphone in the R320 million Durban Solid Waste (DSW) fraud case has hit another snag.

One of the accused in matter (Mthokozisi Nojiyeza), who was dealing with trauma of losing his spouse and unable to attend court, resulted in the latest delay in the matter before the Durban High Court, which has since been adjourned to January 2026.

The State had indicated that it was at a stage in the main trial where it wished to use as evidence data downloaded from his cellphone.

However, Nzuza’s lawyers have objected to the seizure of his cellphone, arguing that he did not agree to the police taking it. They said the police violated his rights by obtaining the phone under false pretences.
