Divorce Order Set Aside, Fresh Hearing Ordered; Court Stresses Right To Rebut Digital Evidence
The Bombay High Court has set aside a divorce decree passed by the Nashik District Family Court, holding that WhatsApp conversations by themselves cannot establish cruelty in matrimonial disputes unless they are proved through proper legal evidence and the opposite party is given a fair chance to respond.
A division bench comprising Justices Bharati Dangre and Manjusha Deshpande made the observations while allowing an appeal filed by the wife, who had challenged the family court's order granting divorce to her husband.
