HC Denies Biological Father's Visitation Plea

Court upholds child's best interest, denies plea of a biological father to meet his child post-divorce

In a significant ruling, the Gujarat High Court has refused to grant visitation rights to a biological father who sought to meet his child post-divorce, stating that it would not be in the child's best interest. The court upheld a Family Court order which had earlier rejected the father's plea for both interim custody and visitation.

The case revolves around a couple whose marriage was annulled in 2019. After divorcing by mutual consent, both individuals remarried. The custody of their child was awarded to the mother, who subsequently updated the child's surname to include her new husband's name.
