ConCourt rules against IT director who resigned over new reporting rules

THE Constitutional Court has dismissed an IT director's application for leave to appeal against rulings by the Labour Court and the Labour Appeal Court, both of which found that he was not constructively dismissed.

Reynolds Maleka, who holds a BCom and an MBA, was employed as IT Director at Tyco International, an Irish company, and was placed to work at ADT, a South African subsidiary of Tyco. He worked at the company from 2014 until his resignation in 2017.

Internationally, he reported directly to Paul Birmingham, the global head of IT for Tyco. In South Africa, he reported to Stuart Clarkson, the Managing Director of ADT.

In 2016, Clarkson announced that ADT had appointed Allan Quinn as its new financial director. Quinn would also oversee the IT portfolio, which Maleka headed, as well as take responsibility for logistics and procurement. It was further announced that Quinn would report to Clarkson and that Maleka would, in turn, report to Quinn.
