SUPREME COURT'S 'CAGED PARROT' REMARK TO CBI ON ARVIND KEJRIWAL'S BAIL

The Supreme Court in the case Arvind Kejriwal v. Central Bureau of Investigation, CBI and other connected matters observed and has granted bail to Delhi Chief Minister Arvind Kejriwal in connection with the CBI FIR in the Delhi liquor policy case.

The court pronounced the judgement wherein the petition is filed by Delhi Chief Minister Arvind Kejriwal challenging his arrest and seeking bail in the case registered by the Central Bureau of Investigation, CBI over the alleged Delhi Liquor Policy scam.

The bench comprising of Justice Surya Kant and Justice Ujjal Bhuyan had heard the present matter.

The bench reserved the judgement of September 05, 2024. Both the judges delivered separate judgments.

The bench of Justice Kant held that the arrest of Arvind Kejriwal was legal and he did not suffer from any procedural irregularity.

The bench of Justice Kant held that there being no merit in the contention that the Central Bureau Investigation, CBI in the case failed to comply with the mandate of Section 41 of the Code of Criminal Procedure, CrPC.

The bench was unanimous in the decision to grant bail to Arvind Kejriwal which considering the fact that the chargesheet has been filed in the case and that the trial is unlikely to be completed in the near future.

The coordinate bench imposed the same condition wherein the court granted interim bail in the Enforcement Directorate, ED case will apply in this case too. This would mean that Arvind Kejriwal cannot visit the office of the Chief Minister and Delhi Secretariat.
