SUPREME COURT TO STATES OR UTS: MAINTAIN OLD PANEL OF ADVOCATES FOR AT LEAST SIX WEEKS AFTER GOVT CHANGE TO AVOID ADJOURNMENTS

The Supreme Court in the case Sachin Kumar vs. The State Of Uttarakhand observed and has expressed its dilemma regarding how, for the last few months, the panel of Advocates in the States or Union Territories has witnessed change after the shift in political power.

The court in the case observed that this change in the panel often results in adjournments.

Adding to it, the court stated that it is true that the States or Union Territories have the power to change their empanelled Advocates, but while doing so, they must ensure that the Court’s functioning is not adversely affected.

Against the said backdrop, the Supreme Court has proposed that the States or Union Territories maintain the previous panel of Advocates for at least six weeks while changing the panel of Advocates. The court suggested the same to avoid adjournments.
