The Supreme Court in the case Agriculture Produce Market Committee, Surat vs. State Of Gujarat observed and has declined to interfere with the order passed by the Gujarat High Court wherein the court directed the Agricultural Produce Market Committee, APMC Surat for auctioning the land which is allegedly misappropriated for the construction and running of a five-star hotel.

The Supreme Court in the case observed that the Surat to auction the land for allegedly misappropriating the construction and for running of a five-star hotel.
The bench comprising of CJI DY Chandrachud and Justice JB Pardiwal was hearing the matter wherein it challenges the interim order of the High Court against the filed in a batch of SLPs by APMC and Hotel Shilpi Pvt. Ltd.
The bench headed by CJI asked that, how can the Agriculture Produce Market Committee to construct a five-star hotel on the land meant for constructing market yards for agricultural products.
The bench of CJI stated that, Thank God! The High Court intervened! This is a scam... The government may be a willing accomplice.
In the present case, the Public Interest Litigation was filed before the Gujarat High Court on the alleged misappropriation of public funds by the office bearers of the Agricultural Produce Market Committee, APMC.
It being the case of the Public Interest Litigation, PIL petitioners that the Agricultural Produce Market Committee, APMC had wrongly utilized the 'Market Committee Fund' worth Rs.98 crores in the construction of a Five Star Hotel on a piece of land which is given by the State Government for the construction of a principal market yard in District-Surat.
