HC allows embryo transfer beyond legal age limit

The Delhi High Court has allowed frozen embryo transfer of cryopreserved embryos to a woman, despite her having exceeded the upper age limit prescribed for the procedure under the law, observing that reproductive rights and access to parenthood cannot be defeated by purely technical or pedantic reading of the law.
A bench of Justice Purushaindra Kumar Kaurav, in his verdict released on May 30, observed that the objective of the Assisted Reproductive Technology (Regulation) Act, 2021 (ART Act) is to ensure ethical and safe practices, not to create insurmountable barriers that defeat the legitimate continuation of lawfully initiated treatment processes.
