The Delhi High Court in the case Mohammad Mazhar Ahmed v. Govt Of NCT Of Delhi And Ors observed and has issued notice wherein the petition is filed challenging Delhi Waqf Board's 'silence' on alleged illegal construction on a graveyard situated at Idgah Road.

In the present case, the petition is filed by one Md. Mazhar Ahmed wherein he claims that the site is a notified Waqf property which has been subjected to alienation by way of 'fraudulent transactions', which results in unauthorized construction by desecrating the graves.
