uMhlanga residents seek court interdict against road upgrade

THE Umhlanga Ratepayers and Residents Association sought an urgent interdict to suspend the planned Herrwood Drive upgrade to four lanes.

The Umhlanga Ratepayers and Residents Association (URRA) asked the court to interdict Balwin Properties and its contracted agents from proceeding with the proposed widening of Herrwood Drive, uMhlanga - from Herrwood Circle to Mahogany Drive - including any excavation or reconstruction of driveways along Herrwood Drive, pending the completion of a proper public participation process as contemplated in Chapter 9 of the eThekwini Municipal Planning and Land Use Management Second Amendment By-Law 2021 including the affected property owners whose properties are situated along or adjacent to Herrwood Drive.

This week, the high court granted an interim order in the matter.

In terms of the provisional order, Balwin Properties Limited and its contracted agents undertake not to excavate or reconstruct driveways of private properties along Herrwood Drive, between Herrwood Drive Circle and the Mahogany Road intersection.

This is an interim interdict until October 20, 2025.

Balwin Properties Limited is the owner of the site that is situated within the Izinga Phase 2D development area in uMhlanga Rocks. Prior to Balwin’s buying the site, Tongaat Hulett Developments (Pty) Ltd (“THD”) was the primary developer of Izinga Phase II and provided the installation and road construction for the Izinga development.
