HC refuses to relax accused's travel bar in Rs 4.3-cr case

Criminal breach of trust case: Accused had challenged his anticipatory bail condition as 'violation of fundamental right'

The Gujarat High Court on Monday dismissed a petition filed by an accused in a cheating case to modify a condition of his anticipatory bail plea, which stated that he needed to take prior permission of the court before going abroad. The petition called it a violation of his fundamental right and that it caused him inconvenience.

The HC, however, noted that it was aware that as held in the catena of decisions by the Hon'ble Apex Court, Article 21 of the Indian Constitution and the personal liberty guaranteed therein, includes the freedom to travel abroad.
