Let us consider a situation in which a woman has evening. The person who ran her over did not intend to kill her. The criminal intent of a person is of great importance in the determination of guilt at a criminal trial. There can be three scenarios: I. The perpetrator intended to run over and kill another person but missed such person and ran over and killed the woman; II. The perpetrator intended to crash into another vehicle and cause damage to that vehicle but instead ran the woman over; III. The perpetrator was on his phone while driving and ran the woman over due to his negligence. In all of the abovementioned scenarios, the woman is run over and killed by the perpetrator, but not all of the scenarios will result in the perpetrator being accused or convicted of murder. The “mens rea” or criminal intent is the individual’s state of mind at the time of the commission or omission of the offence.
