The Bharatiya Nyaya Sanhita’ Bill (“BNS” or “the BNS Bill” or “the Bill”) introduced during the conclusive session of the monsoon session in Parliament, represents a significant legislative initiative with the primary objective of supplanting the Indian Penal Code of 1860 (“the Code” or “IPC”), a relic of the British colonial administration in India.

Charting Legal Frontiers: A Brief Review of the Proposed Law in Criminal Jurisprudence

The proposed BNS seeks to usher in a comprehensive legal framework characterized by several pivotal reforms. At its core, BNS endeavours to institute a paradigm shift towards gender neutrality in addressing offenses. In recognizing the evolving societal dynamics, the bill incorporates provisions specifically tailored for the enhanced protection of women and children. Notably, the proposed legislation takes a formidable stance on crimes related to sedition, subversive activities, separatist endeavours, or any actions perceived as jeopardizing the sovereignty and unity of India. A salient feature of the BNS is its proactive approach to combating organized crime and armed rebellion.
