Petitions had challenged provisions, termed the Act unconstitutional; provision of 10-year imprisonment for land grabbing to stay with retrospective effect
HC dismisses group of 1,700 applications

In an important legal decision, a Gujarat High Court bench led by Chief Justice Sunita Agarwal and Justice Aniruddha Mayee has dismissed several groups of petitions against the Gujarat Land Grabbing (Prohibition) Act, 2020. The law, established to combat land grabbing, faced challenges from as many as 1,700 petitions. However, the High Court affirmed that the legislation aligns with central laws and it does not run contrary to the Article 254 of the Constitution, for want of presidential assent

Detailed legal analysis upholds act

The Court addressed each point raised by the petitioners' counsels, ultimately finding no substantial reason to declare the Gujarat Land Grabbing Prohibition Act, 2020, and its associated rules unconstitutional.
