3-judge bench to hear ‘choice of the party’ on court for anticipatory bail

A three-judge bench of the Supreme Court will decide whether it is the “choice of the litigant” to move the High Court for anticipatory bail or is it mandatory to first approach a Sessions Court.
On Wednesday, the top court’s two-judge bench of Justices Vikram Nath and Sandeep Mehta said that the matter needs to be heard by a three-judge bench and referred it accordingly.
