The court, which is yet to pass its judgement on the contempt notice issued to Ramdev, Balkrishna, and Patanjali Ayurved Ltd for misleading advertisements, was informed by Patanjali's senior advocate Balbir Singh that the sale of these products has ceased.
The bench of justices Hima Kohli and Ahsanuddin Amanullah further inquired if the stockists have also stopped storing and selling these products, and asked for an affidavit confirming the same. Singh assured the bench that an affidavit will be filed.
Singh also mentioned that the company has communicated with the channels airing advertisements for these products. The bench noted that the affidavit would influence the reserved orders.
The court noted that thecounsel for Patanjali Ayurved Ltd, Balkrishna, and Ramdev have requested time to file affidavits detailing the measures taken to recall the advertisements and products whose licences have been suspended.
The bench directed that the affidavit should be filed within three weeks. The bench also acknowledged Patanjali's counsel's submission that the proposed affidavit is without prejudice to their right to challenge the suspension order of these products' licences at the appropriate forum.
