Acting as an appointed attorney for a loved one can seem straightforward but regularly requires consideration of a number of different aspects.
I was asked for advice recently by an attorney who was acting on behalf of her mother, who no longer had the capacity to manage her own affairs. She wanted to sell her mother’s house and had been told by a friend that she could do whatever she wanted as she was the attorney. The solicitors acting for her in relation to the sale had asked her whether her mother had a Will, and if so, what it said, and whether there was any mention of the property in it. The daughter did not know why the question was being asked and wanted some clarity from me.
